JUSTICE BIRENDRA KUMAR ORAL ORDER 26-06-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 8/20 (B) (ii) (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985. From a car 64 Kg. of Ganja was allegedly recovered and the petitioner and another co-accused were arrested from nearby the car.

Submission of the learned counsel for the petitioner is that car is not of the petitioner nor the petitioner was travelling in the said car. The petitioner was apprehended merely on suspicion. Petitioner has stated on oath that he has got no criminal antecedent.

No.18604 of 2018 (4) dt.26-06-2018 2/2 furnishing of the bail bond that the car is not standing in the name of the petitioner or any of his family members thereafter, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bidupur Police Station Case No. 280 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
