2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 310(2) of BNS.

3. The case of the prosecution is that some unknown miscreants have entered the house of the informant and snatched a diamond chain of the informant's wife.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. The name of this petitioner has transpired on the basis of confessional statement of co-accused

Patna High Court CR. MISC. No.40248 of 2026(2) dt.23-06-2026 2/3 Uday Bhushan. Nothing has been recovered from the possession of this petitioner. Save and except confessional statement, there is nothing against him. From perusal of the order of the learned trial court, it is clear that learned trial court has recorded that in para-67 of the case diary, there is CCTV footage wherein the petitioner was identified. From perusal of para-67, it is clear that the I.O. has recorded that five persons were seen entering the house and going from the house but they have masked their face, this goes to show that the petitioner was not identified in the CCTV. Moreover, the petitioner is languishing in judicial custody since 14.02.2026.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and has submitted that petitioner is having criminal antecedent of three cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Agam Kuan P.S. Case No. 103 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief
