====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-06-2025 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/34 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, when the informant reached Taraiya bazar by his Four wheeler, due to traffic jam, an altercation took place with two persons who were also travelling on a motorcycle. People, assembled on the spot, anyhow pacified them. In the meantime, when the informant was returning to his Four wheeler, unknown miscreants fired two three round bullets, one of the bullets hit informant's thigh.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has come in this case during course of investigation. Learned counsel submits that

No.39455 of 2025(2) dt.26-06-2025 2/2 save and except suspicion, there is no other direct or indirect evidence against the petitioner to show his complicity in the occurrence. There is no eye witness to the occurrence. Coaccused, with similar allegation, have already been allowed prearrest bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No. 53545/2024 (annexure P3). Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 13, Saran at Chapra in Taraiya Police Station Case No. 157/2017, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
