JUSTICE SUDHIR SINGH ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 395 of the I.P.C.
The prosecution story, in brief, is that on 21.11.2015 in the night about ten unknown persons entered into the house of the informant and at the point of dagger looted Rs.15000-16000/- cash, jewellary and two mobile phones and from the house of his cousin Bhikhari Sah they also looted Rs.15,000/- cash and jewellary and threatened not to make noise otherwise kill them. It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.12.2015 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of
Patna High Court Cr.Misc. No.30607 of 2016 (3) dt.08-09-2016 2/2 witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on the confessional statement of co-accused. The petitioner has not been put on Test Identification Parade. There is no recovery of any incriminating article from the possession of the petitioner. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Manjhi P.S. case No.228 of 2015.
