The petitioner seeks bail in connection with Sadar P.S. Case No. 349 of 2016, registered under Sections 401, 411, 413, 414, 420,467, 468 and 120(B)/34 of the Indian Penal Code. The accusation is that one person was apprehended boarding on the motorcycle in suspicious condition, who disclosed his name as Niraj Mahto, who also disclosed that this motorcycle was stolen by himself and his other associates and also informed that he has informed his associates to come near Hanuman temple, Station road, Darbhanga. Thereafter, the Police reached there and on the instruction of apprehended person Chandan Mandal, Suraj Sahani and Murari Kumar @
Patna High Court Cr.Misc. No.13537 of 2017 (2) dt.07-04-2017 2/2 Bhola (Petitioner) were apprehended by the Police. On search, one mobile phone was recovered from the possession of the petitioner. The apprehended persons also disclosed that they have committed the theft of the motorcycle and on the confessional statement of the accused persons, including the petitioner, recovery of stolen motorcycle has been made from the house of one Om Prakash Yadav for which Sadar P.S. Case No. 329 of 2016 was registered on 27.08.2016.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has no criminal antecedent is in custody since 05.09.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 5th Addl. Sessions Judge, Darbhanga in connection with Sadar P.S. Case No. 349 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner. (Rajendra Kumar Mishra, J) manish/- U T
