ANJANA MISHRA ORAL ORDER 03-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 19.01.2018 in connection with Dehri (Indrapuri) P.S. Case No. 566 of 2015 registered for the offences punishable under Section 302/201 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not named in the First Information Report but subsequently, on the basis of the confessional statement made before the police by one Wakil Kumar and Amarjeet Kumar, the petitioner's name has been brought in, in connection with the present case. Learned counsel for the petitioner further submits that on the basis of such confessional statement made before the

No.19533 of 2018 (3) dt.03-05-2018 2/2 police and there being no recovery from him, the petitioner may be extended the privilege of bail as such confessional statement made before the police has no evidentiary value. Learned counsel for the State after perusal of the case diary submits that apart from the confessional statement made before the police, there is no further material in the case diary. In view of the aforementioned facts and circumstances and also that the petitioner is having a clean antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M, Dehri, District:- Rohtas, in connection with Dehri (Indrapuri) P.S. Case No. 566 of 2015.
