JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.
It is alleged that one motorcycle suspected to be stolen was parked in front of the shop of the petitioner when the petitioner accepted that he purchased the same on conditional sale for `20,000/-.
It is submitted by learned counsel for the petitioner that the motorcycle was not recovered from the possession of the petitioner and there is nothing on record to suggest that the petitioner was anyway connected with the alleged motorcycle. A statement has been made in para 3 of the petition that the
Patna High Court Cr.Misc. No.24460 of 2015 (2) dt.29-06-2015 2/2 petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kishanganj in connection with Kochadhaman P.S. Case No. 226 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bond of the petitioners will be accepted on filing of the affidavit by the petitioner before the learned court below to the effect that he will regularly co-operate in the investigation. Non-co-operation in the investigation by the petitioner will give liberty to the learned court below to cancel the bail bonds of the petitioner.
