JUSTICE SUDHIR SINGH ORAL ORDER 20-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 302, 120(B) and 201/34 of the I.P.C. and Section 27 of the Arms Act.

Allegation is that the accused persons with their associates have committed murder of the father of the informant after hatching criminal conspiracy and thrown the dead body. It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.5.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. Except for the confessional statement of the co-accused, there is no other substantive evidence

Patna High Court Cr.Misc. No.35177 of 2016 (3) dt.20-10-2016 2/2 to suggest his implication in the present case. The other coaccused have been granted bail vide Cr.Misc.No.37244 of 2016 and Cr.Misc.No.28497 of 2016.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. case No.112 of 2015.
