Petitioner is an accused in a case registered for offence under sections 395, 397 and 412 IPC. The petitioner claims parity with co-accused Ravi Paswan, who has already been allowed bail by this clourt vide order dated 17.2.2018, passed in Cr.Misc.No. 62918 of 2017.
Patna High Court Cr.Misc. No.20031 of 2018 (3) dt.21-05-2018 2/3 The consideration for bail is that though as per the allegation, the accused persons had concealed their face by covering it, but they are said to have been identified in the TI parade, as such, such identification is not trustworthy. There is no recovery from the petitioner. Petitioner is in custody in connection with this case since 10.7.2017. Prior to the lodging of this case, he is accused in two other cases mentioned in paragraph 3 of the bail application.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate II, Nalanda at Biharsharif in Rahui (Wena) Police Station Case No. 90 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.
(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
