====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-02-2021 Heard Mr. Ritesh Kumar Narayan Singh, learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks bail in connection with Atri P.S. Case No. 284 of 2020 dated 16.08.2020 instituted for the offence under Sections 272 and 273 of the Indian Penal Code and under Section 30(a)(d) of the Bihar Prohibition & Excise Act, 2018.
50 litres of locally brewed Mahua liquor and two aluminum utensils are said to have been recovered from the possession of the petitioner.
Learned counsel for the petitioner has submitted that he has wrongly been made accused in
Patna High Court CR. MISC. No.37060 of 2020(2) dt.02-02-2021 2/2 this case. In fact, in the impugned order there is a wrong reference of recovery of 1600 litres of Mahua liquor. The petitioner, at the time of search, was tending his buffalo when he was arrested and made accused in the present case.
The petitioner is in custody since 17.08.2020. Regard being had to the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Atri P.S. Case No. 284 of 2020.
