The petitioner has preferred this application for grant of regular bail in a case registered under sections 25(1-B)(a) and 26 of the Arms Act.

As per the prosecution case, one loaded country made pistol with a live cartridge is said to have been recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case as also in large number of cases details of which has been given in paragraph no.3 of the petition. The petitioner is in custody since 15.1.2021 and chargesheet has been submitted in the case. The application for bail is opposed by learned

Patna High Court CR. MISC. No.49562 of 2021(2) dt.22-02-2022 2/2 A.P.P. for the State who submits that the petitioner is an accused in large number of cases from before.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Raghopur P.S. Case no.13 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Birpur.
