ANJANA MISHRA ORAL ORDER 03-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 08.11.2017 in connection with Sahjahanpur P.S. Case No. 43 of 2017 registered for the offences punishable under Sections 457, 382 of the Indian Penal Code. Later on, section 395, 412 of the Indian Penal Code was added.

Learned counsel for the petitioner submits that the petitioner was taken into custody in connection with Hilsa P.S. Case No. 440 of 2017 and thereafter on the basis of his self confession made before the police, which has no evidentiary value, the petitioner has been roped in, in connection with the present case. Learned counsel for the petitioner submits that save and except few house hold articles which belongs to himself, there

Patna High Court Cr.Misc. No.19965 of 2018 (3) dt.03-05-2018 2/2 has been no recovery from the petitioner. The petitioner has also not been placed on T.I. Parade till date.

In view of the aforementioned facts and circumstances and there being no material, save and except, he confessional statement before the police by the petitioner himself, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Patna City, Patna, connection with Sahjahanpur P.S. Case No. 43 of 2017.
