JUSTICE SATYAVRAT VERMA ORAL ORDER 09-02-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Ram Krishna Nagar P. S. Case No.140 of 2021, instituted for the offences under Sections 457, 380, 411 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 08.04.2021 and charge-sheet has been submitted in the case and the informant alleges that Golu Kumar @ Pehelwan was caught by the informant and his landlord while he was trying to commit theft in the house. The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that petitioner is not named in the F.I.R. and his name

Patna High Court CR. MISC. No.49996 of 2021(3) dt.09-02-2022 2/2 transpired in the confessional statement of Golu Kumar. It is thus submitted that neither the petitioner was present at the place of occurrence nor he has committed any occurrence. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and his name transpired in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIII, Patna in connection with Ram Krishna Nagar P. S. Case No.140 of 2021.

The application stands allowed.
