====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 04-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 409, 420 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he has embezzled government money in purchasing solar lights.

It has been submitted on behalf of the petitioner that petitioner has got no criminal antecedent. He has been made accused due to mistake of fact. For misappropriation of public money in respect of installation of solar lights has been denied by the petitioner. It has further been submitted that the petitioner is ready to deposit Rs.25,000/- in the court below which shall be subject to the final disposal of the case. It is further submitted that other co-accused has been granted bail vide Cr. Misc. no. 26845 of On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid fact that petitioner shall deposit

No.24253 of 2015 (3) dt.04-09-2015 2 / 2 the amount of Rs.25,000/- in the court below which shall be subject to the final disposal of the case, let the above named petitioner, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar , in connection with Dhansoin P.S. Case no. 121/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
