Petitioners apprehend their arrest in Jehanabad P.S. Case No.731 of 2017, registered under Sections 341, 323, 324, 380, 354(B), 448, 427 and 34 of the Indian Penal Code. The informant alleged that the petitioners committed dacoity in seven houses and when the informant protested, the petitioners entered into her house, assaulted the informant and broke her television. The accused persons-petitioners also took away different articles from her house. The informant had given petition to

No.37173 of 2019(2) dt.18-06-2019 2/2 the Officer-in-Charge of Jehanabad Police Station on 14.10.2017 but no case was lodged and on the petition filed by the informant before the District Magistrate, Jehanabad, the present case was registered. Learned counsel for the petitioners submits that petitioners are neighbours of the informant. The allegation of dacoity is false and concocted. Some dispute occurred due to flow of drainage water and obstruction of passage. No petition was given to the S.H.O., Jehanabad on 14.10.2017. Nobody has come forward to support the case of the informant that any dacoity was committed in the house of any resident of the Mohalla.

Taking into consideration the facts and nature of allegations made against the petitioners and the fact that the petitioners are the residents of the same Mohalla, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jehanabad in connection with Jehanabad P.S. Case No.731 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
