Petitioners seek bail in a case registered for the offences punishable under Sections 147, 341, 323, 324, 337, 338, 307 and 504 of the Indian Penal Code.
This is a case of misuse of privilege of bail. Petitioners are in custody since 28.02.2018.
Submission is that after commitment of the trial before the Court of Session, the petitioners could not appear as they had gone to earn their livelihood.
Considering the period already undergone, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with
Patna High Court Cr.Misc. No.23977 of 2018 (6) dt.28-08-2018 2/2 two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 688 of 2012 arising out of Laukhi Police Station Case No. 46 of 2010, subject to the condition that the petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners and conclude the trial after keeping the petitioners in custody as well as condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below.
