The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

It is alleged that minor daughter of the informant has been abducted by all the F.I.R named accused persons including the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and due to neighborhood dispute he has falsely been implicated in the present case. It is also submitted that the daughter of the informant has fled away with the petitioner with her own sweet will and she has solemnized marriage

Patna High Court CR. MISC. No.50008 of 2021(4) dt.10-10-2022 2/2 with the petitioner and they are living together as husband and wife. A supplementary affidavit has been filed on behalf of the victim herself bringing on record the marriage certificate as Annexure-1. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Muffasil) P.S. Case No. 161 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
