The petitioner seeks bail in Laukhai P.S. Case No. 204/2016, registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.

The petitioner is not named in the F.I.R. The informant lodged the case against unknown for theft of different electronic articles from the shop. From the possession of the petitioner one Lava mobile was recovered.

It is submitted that the seizure list is at page 17 and the IMEI no. of the recovered mobile from the possession of the petitioner does not tally with IMEI no. of the stolen mobile mentioned at page 13. The petitioner has not been put on Test Identification Parade. The petitioner is in jail since 23.12.2016.

Patna High Court Cr.Misc. No.10951 of 2017 (2) dt.07-03-2017 Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in connection with Laukahi P.S. Case No. 204/2016.
