Petitioners seek bail in connection with Haspura P.S. Case No. 138 of 2018 registered for the offence punishable under sections 302/34 of the Indian Penal Code. Learned counsel appearing for the petitioners submits that petitioners have falsely been implicated in this case. There is no eye witnesses to the alleged occurrence. The charge has already been framed in this case and there is no possibility of tampering with the evidence. Moreover, similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court vide Annexure-2.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Haspura P.S. Case No. 138 of 2018.
