The petitioner seeks bail in Chiksaura P.S. Case No. 21/2016, corresponding to S.Tr. No. 412/2016, registered for the offences punishable under Sections 304(B), 34 of the Indian Penal Code.

The petitioner is the husband of the deceased. Learned counsel for the petitioner submits that the marriage was solemnized about eight years ago. The petitioner has got two children from the wedlock. The deceased committed suicide, but it appears that the petitioner strangulated her to death. The trial has also begun and out of 12 witnesses, 5 witnesses have already been examined.

Patna High Court Cr.Misc. No.11633 of 2017 (4) dt.17-04-2017 2/2 Considering the facts aforesaid and the fact that the petitioner is husband and his wife died on account of strangulation, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected. The trial court is directed to hold the trial on day to day basis and conclude the same within six months from the date of receipt of a copy of this order.

The S.P., Nalanda is directed to ensure the attendance of witnesses in the court of learned Additional Sessions Judge III, Hilsa (Nalanda) so that the trial must be concluded within six months.
