====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 13-01-2023 Heard learned counsel for the petitioner and counsel for Municipal Corporation Mr. Ranjit Kumar Pandey through virtual mode.

Counsel for the petitioner submits that petitioner was employee of Patna Municipal Corporation and retired as Chief Sanitary Inspector after attaining the age of 60 year on 31.05.2012. Counsel submits that after retirement, the petitioner approached orally and by way of several representation for payment of retirement /monetary benefit of first and second A.C.P., group insurance amount with interest, arrears of salary as per 6th pay revision, interest of 5th pay revision from 01.04.1997 to 30.10.2004 along with 18% interest and pay anomalies with effect from 01.02.2007 till due date, an arrears

Patna High Court CWJC No.15383 of 2021(2) dt.13-01-2023 2/2 of pension as per 7th pay scale, etc. Counsel further submits that it has been decided at the level of respondent (Page-16, 17). Counsel for the petitioner further submits that in case of many other similarly situated persons whose name has figured in this letter dated 10.04.2019, those who filed writ petition, the arrears were paid with interest. Counsel for Municipal Corporation submits that the petitioner may be directed to file representation afresh and his payment shall be made as earliest as possible.

Counsel submits that there are thousand and thousand employees working in the corporation and payment of 18% interest to all employees shall give a strong setback to the corporation but for the admissible dues, the corporation assures that it shall be paid within 3 months from today. In this view of the matter, petitioner is directed to file his representation and corporation is directed to amounting all his dues and pay within 3 months from today in case of nonpayment within 3 months from today, the interest of 9 % shall be charged upon the payable amount.

With this direction, this writ application stands disposed off.
