JUSTICE ARUN KUMAR ORAL ORDER 16-02-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with Chousa P.S. Case No. 133 of 2016 registered under section 47(A) of the Bihar Excise (Amendment) Act, 2016.

Allegation in brief is that 10 liters of country made liquor was recovered from the bamboo cluster situated behind the house of the petitioner.

It is submitted that recovery is not from the conscious possession of the petitioner rather it was recovered from the place accessible to anyone and the petitioner has no criminal antecedent except one case in which he is on bail which was lodged in the year 2012.

Considering the said facts and circumstances, the

No.6672 of 2017 (2) dt.16-02-2017 petitioner, namely, Dilo Singh is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Uda-Kishunganj, Madhepura in connection with Chousa P.S.
