Heard learned senior counsel for the petitioner alongwith learned counsel on record Mr. Rajesh Kumar, learned counsel for the informant and learned A.P.P. for the State. The petitioner seeks regular bail in connection with Patliputra P.S. Case No. 205 of 2022 lodged under Sections 323, 324, 376 of the I.P.C.
As per the prosecution case, the allegation of rape and causing injury in the private part of the informant is there in the F.I.R.
Learned counsel for the petitioner submits that from the contents of the F.I.R., it is very much clear that the age of the informant is 29 years, whereas the age of the petitioner is 27

So far as the injury part is concerned, Annexure-2 is the injury report which does not support the allegation made in the F.I.R. Counsel for the petitioner submits that the antecedent of the petitioner is clean and he is in custody since 15.04.2022. Charge sheet has already been filed in this case. Learned counsel for the State opposes the prayer for bail.
Learned counsel for the informant vehemently opposes the prayer for bail and submits that as per the contents of the F.I.R., there is allegation of causing injury in the private part of the informant.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateX, Patna in connection with Patliputra P.S. Case No. 205 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
