JUSTICE SUDHIR SINGH ORAL ORDER 26-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 467, 468, 471, 474 and 420 of the I.P.C. Allegation is that co-accused Sahdeo Singh and Gopal Singh i.e. the petitioner prepared the forged arms licence on the basis of duplicate seal and signature of higher officials and sold the licence in Rs.1500/- per licence.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.6.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The recovery of fake arms licence is said to have been made from the house of co-accused Sahdeo Singh, who was apprehended at the
Patna High Court Cr.Misc. No.36636 of 2016 (4) dt.26-10-2016 2/2 spot. The name of the petitioner has come on the disclosure made by the said co-accused, namely, Sahdeo Singh. There is no recovery of any incriminating article from the possession of the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwant Nagar P.S. case No.168 of 1993.
