JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

2 quintals of wheat and 31 quintals of rice were seized from a tractor when the driver of the tractor disclosed that the petitioner being the owner of the tractor and PDS dealer has asked him to transport the grains.

It is submitted by learned counsel for the petitioner that on the alleged date of occurrence, the stock of the PDS of the petitioner was found nil and the same fact was verified by the I.O., hence, on suspicion, the accusation has been levelled. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.51742 of 2014 (2) dt.05-01-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura in connection with Murliganj P.S. Case No. 168 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
