The petitioner seeks bail in Sadar P.S. case No. 02 of 2017 under Section 366A and other Sections of the Indian Penal Code.
The informant alleged that petitioner kidnapped his minor daughter. The victim telephoned her brother and, on such, the victim was recovered from the office of Jeevika. The victim disclosed that petitioner forcibly kidnapped her and confined her in a room.
The learned counsel for the petitioner submits that the victim, after recovery, made her statement under Section 164 of the Cr. P. C. but she did not allege any ill treatment at the hands
Patna High Court Cr.Misc. No.14897 of 2017 (3) dt.04-05-2017 2/2 of the petitioner but it appears that victim is a minor girl. The petitioner kidnapped her and confined her in a room. Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the same is rejected.
