Report has been received from 3rd Additional Sessions Judge, West Champaran, Bettiah. Perused the same. The petitioner wants to renew his prayer of bail, which was earlier rejected twice vide order dated 23.11.2015 and 29.06.2016 passed in Cr. Misc. No. 27854 of 2015 and Cr. Misc. No. 23249 of 2016, on the ground that the petitioner is suffering in custody since 22.04.2015, the trial has not been concluded within the time given by this Court and as such the petitioner deserves sympathetic consideration.
Learned APP opposes the prayer of bail.
In the facts and circumstances stated above, considering the report of the trial Judge that all the prosecution witnesses have
Patna High Court Cr.Misc. No.18962 of 2017 (3) dt.17-05-2017 been examined and the trial is likely to be concluded within two months and as such, at present, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected.
However, learned trial Judge is directed to conclude the trial as per submission made by him.
