The petitioner apprehends his arrest in a case registered for the offence punishable under Section 306 of the Indian Penal Code.

The petitioner is said to have killed the sister of the informant by poisoning her.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is no direct evidence against the petitioner. It is submitted that only allegation against the petitioner is that he is a conspirator. It is further submitted that no independent witness has supported the prosecution case.

Learned APP for the State opposed the prayer for

Patna High Court CR. MISC. No.49634 of 2021(3) dt.21-06-2022 2/2 anticipatory bail of the petitioner and submitted that petitioner is the husband of the deceased.

Taking into consideration the fact that there is no specific allegation against the petitioner, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Madhubani in connection with Babubarhi P.S. Case No.221 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
