Petitioner is an accused in a case registered for offence under sections 302, 201/34 IPC.

Learned counsel for the petitioner submits that the petitioner has been named in this case on the confessional statement of co-accused Md. Sadique as per paragraph 36 of the case diary and except this there is nothing to implicate the petitioner in the instant case. Even, the dagger alleged to have been used in the murder of the victim who was studying in Madarsa, has been recovered from the house of Md. Sadique. Petitioner is said to be a teacher of the said Madarsa. Considering the aforesaid submissions and the fact that the petitioner is having no criminal antecedent and he is in

Patna High Court Cr.Misc. No.17337 of 2018 (2) dt.09-05-2018 custody since 14.1.2018, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Purnea in Jalalgarh Police Station Case No. 02 of 2018 on the following condition:- One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
