2. The petitioner is apprehending arrest in connection with Charpokhari P.S. Case No. 89 of 2021 instituted under Sections 341, 323, 504, 307/34 of the Indian Penal Code lodged on 2.6.2021 by the informant, Vivek Kumar.

3. As per the prosecution story, the informant alleged that while he alongwith Ashok Thakur were returning home from the market, the accused persons came from behind and assaulted. The allegation against all the accused persons of having assaulted and the reason behind the said assault is that in the year 2019, Brajesh Singh has ousted his wife in which FIR was lodged and he had to remain under judicial custody.

4. Though learned counsel for the petitioner tried to impress upon this Court.

5. Learned APP pointed out that this petitioner not only has criminal antecedents, the FIR is of the year 2021 and there is nothing on record to show why he took three years to take recourse to anticipatory bail.

6. This Court finds force in the submission of the learned APP and the allegations are there against the accused persons including the petitioner, he has criminal antecedent and he has delayed coming to the Court for grant of anticipatory bail, the same is accordingly rejected.

7. However, if he surrenders within a period of four weeks from today and files the bail application, the same shall be taken up and dispose if of preferably on the same day. (Rajiv Roy, J) Ravi/- U T
