In this case, the petitioner is seeking anticipatory bail in connection with Kanti P.S. Case No.605 of 2015, registered for the offence punishable under Sections 498 (A), 365/34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.

Allegation has been made that the daughter of the informant is traceless, but the order sheet of the court below itself shows that in 164 Cr.P.C. statement, the victim has stated that she had gone to Delhi to search her husband as her husband did not visit his house for last two years and she remained there for two months, but she could not locate her husband and she

Patna High Court CR. MISC. No.37063 of 2019(2) dt.18-06-2019 2/2 returned to her matrimonial home and there is no allegation of demanding dowry by the petitioner.

Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate (West), Muzaffarpur in connection with Kanti P.S. Case No. 605 of 2015, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
