JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-05-2015 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Section 406, 420, 467 & 468 of the Indian Penal Code.

The petitioner is the Mukhiya of Rautara Gram Panchayat in the District of Katihar.

Learned counsel for the petitioner submits, referring to the letter dated 04.12.2013 addressed to the Officer-in-charge, Rautra Police Station, which is the basis for institution of the First Information Report, that the allegation is against the Vikash Mitra of the said Gram Panchayat who is said to have included the

No.2935 of 2015 (3) dt.19-05-2015 names of such persona in the BPL list for the purpose of grant of benefit under Indira Awas Yojna who were not entitled for benefit under the scheme. Learned counsel for the petitioner submits that there is no allegation against the petitioner of misappropriation of any Government money.

In view of the submissions as above, let petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in Rautara P.S. Case No. 123 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
