The petitioner, who is in custody, seeks bail in connection with Adapur P.S.Case No. 131 of 2016 registered under Sections 272 and 273 of the Indian Penal Code and Sections 47A and 54 of the Bihar Excise (Amendment) Act, 2016. Allegation is that 05 litres of country made liquor were recovered from the hut of the petitioner. It is submitted that nothing was recovered from the conscious possession of the petitioner and neither copy of the seizure list was given to the petitioner nor to his family members and he has no criminal antecedent and has been in custody since 18.11.2016.

Considering the aforesaid facts and circumstances, the

No.6639 of 2017 (2) dt.15-02-2017 2/2 petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Raxaul at East Champaran, Motihari in connection with Adapur P.S.
