The petitioner seeks bail in a case registered under Sections 341, 323, 457, 436/34 of the Indian Penal Code. Allegation is that the accused persons including the petitioner broken the lock of main gate of the informant and after entering into his house set fire, due to which household articles burnt.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.04.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The alleged date of occurrence is said to

Patna High Court CR. MISC. No.36854 of 2019(2) dt.27-06-2019 2/2 have taken place in the night. No Source of identification is disclosed in the F.I.R. Hence identification of accused itself is doubtful. The allegation made in the F.I.R. is denied by the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Shri Ranjay Kumar, Judicial Magistrate, 1st class, Masaurhi in connection with Punpun P.S. case No.113 of 2019.
