JUSTICE SUDHIR SINGH ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 147, 148, 149, 341, 327 and 302 of the Indian Penal Code and 27 of Arms Act.

It is alleged in the FIR that all FIR named persons including this peittioner entered in the house of the informant and started beating the persons present there. Karu Paswan and his four sons started making indiscriminate firing and due to their assault, some persons belonging to informant's side became injured where from the injured were taken to hospital for treatment where Chhoto Paswan died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.04.2016. Charge sheet has been

Patna High Court Cr.Misc. No.31338 of 2016 (6) dt.04-10-2016 2/2 submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City in connection with Khajekalan P.S.Case No. 59 of 2016.
