Petitioner seeks bail in Jogapatti P.S. Case No.464 of 2017 instituted for the offence under Section(s) 363, 366-A Indian Penal Code and Section 8 of the POCSO Act pending in the Court of the Additional Sessions Judge, 1st, Bettiah. Prayer of the petitioner for bail was earlier rejected by this Cout.
A report was called for from the Court below which has been received. It is mentioned in the report that only victim is required to be examined in the case. Trial is likely to be concluded within three months.
In such circumstances, this Court is not inclined to
Patna High Court CR. MISC. No.37179 of 2019(3) dt.24-07-2019 2/2 enlarge the petitioner on bail since the trial is at its fag-end. Prayer of the petitioner for grant of bail is rejected. The trial Court is directed to conclude the trial positively within a period of six months from the date of receipt/production of a copy of this order either by fixing the case on day to day basis or by giving short adjournments. Liberty is given to the petitioner to renew his prayer for bail after six months, if trial is not concluded within aforesaid period.
