JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-419, 420, 379, 401 of the Indian Penal Code. According to prosecution case itself, the culprits took the articles and cash of the informant on 17-02-2016 and after that, the informant went to his home but again on 19-02-2016, he came at Patna and, thereafter, he claimed to have identified the petitioner and other accused, who were caught by the police. In course of investigation, the house of the petitioner was raided and some articles were recovered but admittedly, ATM card of the informant was not recovered in the aforesaid raid. Submission on behalf of petitioner is that household

Patna High Court Cr.Misc. No.28615 of 2016 (2) dt.22-07-2016 2/2 articles are said to have been recovered from house of the petitioner. Moreover, the aforesaid articles have not been put on Test Identification Parade.

Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Patna Rail P.S. Case No. 36 of 2016 to the satisfaction of learned Railway Judicial Magistrate, Patna.
