JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-07-2015 Heard learned counsel for petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Muzahidpur (Babarganj) P.S. Case No. 49 of 2015 registered under Sections-307, 427/34 of the Indian Penal Code and 3⁄4 of Explosive Substances Act.

The accusation against petitioners is that they lobbed bomb on the shop of the informant but admittedly, none has sustained any injury.

The contention on behalf of the petitioners is that there was land dispute between the parties and the informant has lodged this case in collusion with one Mani

Patna High Court Cr.Misc. No.24704 of 2015 (2) dt.14-07-2015 2/2 Paswan ASI of Babarganj Police Station, District-Bhagalpur. It is pointed out on behalf of the petitioner that much prior to institution of the present case, petitioner No. 1 had given an informatory petition before the learned Chief Judicial Magistrate, Bhagalpur against the informant of the present case as well as above-said Mani Paswan, ASI.

Taking note of the facts and circumstances of the case as well as submission of the parties and keeping in mind that petitioners do not have any criminal antecedent, let the petitioners named above, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Muzahidpur (Babarganj) P.S. Case No. 49 of 2015 to the satisfaction of Chief Judicial Magistrate, Bhagalpur subject to conditions as laid down u/S 438(2) of the Cr. P.C.
