JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2017 This is an application for grant of bail for offences punishable under Sections 30 of the Bihar Excise Act. Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that other similarly situated co-accused persons have been granted bail by this Hon'ble Court vide Cr. Misc. nos. 8332 of 2017 and 6085 of 2017. As such, petitioner also deserves bail. Heard learned A.P.P. also.
From perusal of Annexure-1 it appears that earlier prayer for bail of the petitioner was also rejected on 14.2.2017 passed in Cr. Misc. no. 4286 of 2017 with liberty to the petitioner to renew his prayer before the court below itself after completion of six months in judicial custody. However, it appears that
Patna High Court Cr.Misc. No.15970 of 2017 (2) dt.12-04-2017 2/2 petitioner has filed this application just after two months Considering the facts and circumstances, there is no need to modify the order aforesaid. As such, this application is dismissed.
