JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-05-2015 This application stood dismissed as regards petitioner No.3 by an order dated 09.01.2015 since he was arrested during the pendency of the present application.

The petitioners seek anticipatory bail in a case registered for the offences punishable under section 304 of the Indian Penal Code.

Learned counsel for the petitioners submits that police upon investigation had filed final report finding the case to be true but clueless. The court, however, took cognizance of the offence under section 304 of the IPC differing with the report of police and issued summons against the accused persons. He has produced before me a copy of the order dated 02.04.2015 whereby petitioner

Patna High Court Cr.Misc. No.50453 of 2014 (3) dt.07-05-2015 2/2 No.3 of the present application has been granted regular bail. In view of submissions, as above, the petitioners No.1 Chandeshwari Yadav and 2. Kamleshwari Yadav, in the event of their arrest/ surrender within a period of six weeks from today shall be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri A. K. Rai, learned Judicial Magistrate, 1st class, Supaul in connection with Triveniganj PS case No. 109/2000, subject to condition as laid down u/s 438(2) of the Code of Criminal Procedure.
