JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-05-2015 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State. After First Information Report was instituted on 19.3.2012, the petitioner had approached learned Sessions Judge, Kishanganj for grant of anticipatory bail vide ABP No. 308 of 2012 which was dismissed on 17.7.2013. There is no explanation why petitioner approached this Court thereafter, in 2015 and evaded arrest during this period.

In such view of the matter, I am not inclined to grant the petitioner the privilege of anticipatory bail. The prayer for anticipatory bail is rejected. However, the petitioner is directed to surrender before the Court below within two weeks from today and if he does so

Patna High Court Cr.Misc. No.3109 of 2015 (3) dt.19-05-2015 and seeks regular bail, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of the present anticipatory bail application. (Chakradhari Sharan Singh, J) ArunKumar/- U
