The petitioner seeks bail in connection with Gopalpur P.S. Case No. 60 of 2024 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 325, 307, 302, 427, 435, 504 & 506 of the Indian Penal Code. Earlier vide order dated 16-12-2024, passed in Cr. Misc. No. 58328 of 2024, anticipatory bail of the petitioner was rejected by a Co-ordinate Bench of this Court.

The Informant alleged that on 06.05.2024, 14 named accused armed with weapons set his hut on fire and assaulted his family, causing serious injury to Shiv Prasad. On 07.05.2024, the accused returned and allegedly murdered his

It has been submitted on behalf of the petitioner that the petitioner is in custody since 02-10-2024. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that parties are co-villagers and there is land dispute pending between the parties, which is evident from the FIR itself. There is no specific allegation against the petitioner. Petitioner was only member of the mob. Other similarly situated co-accused persons has been enlarged on anticipatory bail by a Co-ordinate Bench of this Court vide order dated 16-12-2024, passed in Cr. Misc. No. 59428 of 2024.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no specific allegation against the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on

Patna High Court CR. MISC. No.40936 of 2025(2) dt.09-07-2025 3/3 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Gopalpur P.S. Case No. 60 of 2024.
