2. The petitioner seeks regular bail in connection with Katihar (Town) P.S. Case No. 44 of 2026 lodged on 09.01.2026, for the offence punishable under Sections 25(1-B)(a) and 26 of Arms Act.

3. The prosecution case, in brief, is that on 08.01.2026, Masudan Kumar received secret information that the present petitioner, had concealed illegal firearms in his house and might commit an untoward incident. Acting upon the information, the informant along with the police team raided the house of the petitioner and apprehended him. During search, three country-made pistols, two live cartridges, some wet substance and Rs. 3,55,040/-, an electronic weighing machine

Patna High Court CR. MISC. No.38693 of 2026(3) dt.28-07-2026 2/3 and one mobile phone were recovered and seized. Further on being asked the petitioner disclosed that wet substance is a smack.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel for the petitioner further submits that there is one criminal case pending against the petitioner on which he is on bail. Counsel also submits that the petitioner is in custody since 10.01.2026.

5. Learned APP for the State vehemently opposed the prayer for bail of the petitioner.

6. Taking into consideration that charge-sheet has been filed and the petitioner is in custody since 10.01.2026, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the likewise amount each to the satisfaction of learned C.J.M, Katihar in connection with Katihar (Town) P.S. Case No. 44 of 2026 , subject to the following conditions: (I) One of the bailors shall be the petitioner's own or close member.

(II) The petitioner shall appear on each and every date fixed during the trial and also co-operate in the process of trial.

(IV) The Petitioner shall not commit offence of a similar nature in future.

In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
