JUSTICE ASHUTOSH KUMAR ORAL ORDER 31-05-2021 Heard Mr. Yogesh Chandra Verma, learned Senior Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in connection with Harshiddhi P. S. Case No.135 of 2020, instituted for the offences under Sections 302, 201, 120(B)/ 34 of the I.P.C. The informant is not an eye witness to the occurrence. It has been alleged by her that her son-in-law was having litigation with his agnate, namely, Vashisht Rai. The brother-in-law of aforesaid Vashisht Rai, namely, Manoj Singh was behind the killing of the brother of the deceased (son-in-law of the informant), for which earlier a case was lodged against him. On one occasion, the daughter of the informant was asked by the wife of Vashisht Rai to compound the case against Manoj Singh or else, the family would suffer irreparable damage. Later,

Patna High Court CR. MISC. No.37712 of 2020(5) dt.31-05-2021 2/3 the son-in-law of the informant was found dead on his bed. The grand children of the informant also are said to have been murdered.

It is a heinous case of three murders in which suspicion has been raised against the petitioner, her husband and others.

Learned counsel for the petitioner has submitted that there is no basis for suspecting the hands of the petitioner in this case only on the ground of the husband of the petitioner being on inimical terms with the deceased and the petitioner having once asked the wife of the deceased to compound the case against Manoj Singh, who apparently is related to the petitioner.

Learned counsel for the petitioner has further drawn the attention of this Court to the fact that she is in custody since 24.04.2020 and the case has only been committed to the Court of Sessions. Even the charges have not been framed. The other accused persons are reported to be in custody. Considering the afore-noted facts especially the accusation against the petitioner on the basis of suspicion as also taking into account the period of custody and the stage of the case, the petitioner, above-named, is directed to be released on

No.37712 of 2020(5) dt.31-05-2021 3/3 bail on her furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Harshiddhi P. S. Case No.135 of 2020.

The petitioner, however, is directed to participate in the trial and in the event of her not being present in the trial proceedings on two consecutive occasions without justifiable cause, would render the bail granted to her liable to be cancelled.
