Petitioner Arjun Kumar is not named in the First Information Report which is quite detailed as regards the circumstances attending on the killing of deceased Amrita @ Guddi who was married to accused Vijay Sah on 11.07.2013. On perusal of the First Information Report, there does not appear any scope for inserting any name because all allegations were directed against the husband Vijay Sah.

Subsequently in the confessional statement of Vijay Sah, the name of this petitioner had appeared in connection with accompanying the said accused in a vehicle without further assigning any role to him.

Without going into the merits of the allegations and considering the above facts and circumstances, let petitioner Arjun

No.49946 of 2014 (3) dt.02-07-2015 2 / 2 Kumar be directed to be released on anticipatory bail either in the event of his arrest by the police or surrender in the court below on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 177 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C.
