JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 08-09-2015 The petitioner is aggrieved by the order dated 17.12.2009 (Annexure-9) passed in Consolidation Revision Case No. 103 of 2009 by the respondent Joint Director of Consolidation (H.Q), Bihar, Patna, whereby the petition filed on behalf of the petitioner under Section 35 of the Bihar Consolidation of Holdings and Prevention of Fragmentation Act, 1956 has been rejected. In the considered opinion of this Court, the petitioner has an alternative and efficacious remedy before the learned Bihar Land Tribunal, Patna in view of the provisions contained in Section 9 of the Bihar Land Tribunal Act, 2009. In above view of the matter, the writ petition stands dismissed with a liberty to the petitioner to approach the learned Bihar Land Tribunal, Patna for grant of appropriate relief(s) with respect to the lands under dispute.
