The Petitioner seeks bail in Mufasil P.S. Case No. 448 of 2016 instituted for the offence under Section(s) 366(A)/34 of the Indian Penal Code.

It is alleged in the written report that daughter of the informant has been kidnapped by co-accused Mukesh Kumar and his three friends.

The victim girl has been recovered and her statement under Section 164 Cr.P.C was recorded which has been annexed as Annexure-2 of the petition. From perusal of the statement of the victim girl under Section 164 Cr.P.C, it appears that she has not taken name of this petitioner. In the written report

Patna High Court Cr.Misc. No.11028 of 2017 (2) dt.18-03-2017 2/2 also, there is no any specific allegation of overt act against this petitioner.

It has been mentioned in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Mufasil P.S. Case No. 448 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Shageer/- U T
