2. The petitioner seeks bail in connection with Dhanaha P.S. Case No. 143 of 2023 registered for the offences under Sections 363, 366-A and 34 of the IPC and Section 8 of the POCSO Act.

3. The petitioner is named in the F.I.R. and is in custody since 24.03.2025.

4. The allegation against the petitioner is to kidnap the minor daughter of informant for the purpose of illicit intercourse/marriage.

5. Learned counsel appearing on behalf of the petitioner submitted that during the course of investigation while recording her statement under Section 183 of the BNSS, it is categorically stated by both victim that they were taken by some other persons and not by this petitioner. It is submitted that same facts were also deposed by these victims during the trial and they turned hostile, considering which one of the learned Co-ordinate Bench of this Court granted bail to similarly situated co-accused persons through Cr. Misc. No. 16415 of 2025 dated 02.05.2025. While concluding the argument it is submitted that investigation of this case has already completed, and as such, there is no chance of tampering with the evidence.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.

7. Learned counsel appearing on behalf of informant could not disputed aforesaid factual submission.

8. In view of aforesaid factual submission and by taking note of fact as nothing incriminating stated by victim against petitioner qua his involvement with the present crime in question, coupled with the fact as petitioner remains in custody since 24.03.2025,

Patna High Court CR. MISC. No.41721 of 2025(4) dt.27-11-2025 3/3 accordingly above named petitioner, is directed to be released on bail in connection with Dhanaha P.S. Case No. 143 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VIIth, West Champaran, Bettiah/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
