ANJANA MISHRA ORAL ORDER 02-03-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners, being the father-in-law and the brothers-in-law, are apprehending their arrest in connection with Dhamdaha P.S. Case No.54 of 2014 for allegedly having committed the offences under Sections 302 and 304B of the Indian Penal Code.

Case diary in the present case was called for, which has since been received.

Learned counsel for the petitioners submits that there is a general and omnibus allegation against the accused persons of having attacked the victim lady with fists and feet resulting

Patna High Court Cr.Misc. No.9192 of 2015 (5) dt.02-03-2016 2/2 in her death. It is further submitted that the husband of the deceased lady is already in custody since 5.4.2014. Learned counsel further submits that it cannot be said that it was on account of the assault by these three petitioners, that the deceased lady succumbed to her injuries.

Considering the nature of allegations made and that the husband of the deceased lady is already in custody and also that there being no further material in the case diary, let all the three petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri A. Mishra, learned Judicial Magistrate, 1st Class, Purnea, in connection with Dhamdaha P.S. Case No.54 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
