The petitioner seeks regular bail in connection with Jadia PS case no. 163 of 2017 instituted for the offences punishable under Sections 147, 302, 201, 120B of Indian Penal Code.
The allegation is regarding the accused persons having killed the victim lady and hanged her from a tree on account of non-fulfilment of the demand of dowry. The learned counsel for the petitioner submits that the petitioner is the father-in-law of the victim girl and there is no specific allegation as against him regarding his hand in the death of the deceased. No.22474 of 2018 (5) dt.28-06-2018 2/2 nothing to do with the affairs of the deceased and his son who is the husband of the deceased The main accused is the husband of the deceased who is in custody, hence no prejudice would be caused to the prosecution, in case the petitioner is granted bail. It is further submitted that the petitioner has a clean antecedent and he is in custody since 04.12.2017. It is further submitted that similarly situated co-accused persons who is the dewar and mother-in-law of the deceased have already been granted bail vide order dated 15.05.2018 passed in Cr. Misc. no. 22256 of 2018. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Vth, Supaul in connection with Jadia PS case no. 163 of 2017.
